Terms of use

The terms on which you may use the Solace website and our estate administration service, and the limits of what we do.

1. Who we are

This website and the Solace estate administration service are operated by Aaditya Malhotra, trading as Solace ("Solace", "we", "us"). You can contact us at aaditya@getsolace.co.uk.

2. Accepting these terms

By using this website or our service you agree to these terms. If you do not agree, please do not use them. If you use Solace on behalf of an organisation, you confirm you have authority to bind that organisation.

3. What Solace is, and is not

Solace is an estate administration service. We carry out the administrative work involved in settling an estate on your behalf and on your instructions: corresponding with institutions, gathering valuations, preparing forms for you to check and sign, and following up until each matter is closed.

Important

Solace is not a firm of solicitors and does not provide legal, tax or financial advice. We are not regulated by the Solicitors Regulation Authority, the Financial Conduct Authority or any equivalent body. Nothing on this website or within our service constitutes legal, tax or financial advice, and no solicitor–client relationship is created by using our services.

Solace is not a counselling or bereavement support service.

Administering an estate carries personal legal responsibility that remains yours. As executor, administrator or personal representative you are accountable for the decisions taken and for the accuracy of what is submitted to HMRC, the Probate Registry and third parties. Solace assists you; it does not assume that responsibility. You should obtain advice from a qualified solicitor, accountant or other regulated professional where your circumstances call for it.

4. Eligibility

You must be at least 18 and resident in the United Kingdom. Solace supports estate administration in the United Kingdom only. References to probate reflect the process in England and Wales; Scotland and Northern Ireland differ in important respects.

To instruct us in relation to an estate you must have, or reasonably expect to obtain, legal authority to act for it: as an executor named in the will, an administrator entitled under the intestacy rules, or someone acting with their authority.

5. Your account and your responsibilities

You are responsible for keeping your login details secure and for activity under your account. You agree that the information you give us is accurate and that you have the right to share the documents and data you upload, including where they relate to other people.

Where you give us access to an account, or authorise us to correspond with an organisation on your behalf, you confirm you are entitled to grant that authority.

You are responsible for reviewing anything we prepare for you before it is sent or submitted, and for approving decisions that require your judgement or signature.

6. Acceptable use

You may not use Solace to break the law, to impersonate anyone, to deal with an estate you have no authority over, to upload malicious code, to attempt to gain unauthorised access to our systems, or to scrape or reproduce our content at scale.

7. Information on this website

Our guides are general information, not advice. They reflect the position in England and Wales at the date shown on each page. Law, rates, fees and deadlines change. Always check current figures against GOV.UK before acting, and take professional advice where appropriate.

8. Third parties

Solace corresponds with banks, pension and insurance providers, utilities, HMRC, local authorities and other organisations on your behalf. We do not control how they respond or how long they take. Where we introduce you to an independent professional or support organisation, that party is solely responsible for the services they provide to you.

Links to external websites are provided for convenience. We are not responsible for their content.

9. Fees

Where a fee applies, we agree it with you in writing before any chargeable work begins, and we will tell you what is included and what is not. There is no charge for making an enquiry, for an initial consultation, or for reading our guides.

You will always be told the fee before you commit to anything, and you may decline at that point.

10. Intellectual property

The Solace name, logo, software, design and written content are owned by us or licensed to us. You may read, print and share our guides for personal, non-commercial use with attribution. You may not republish them commercially or use them to train machine learning models without our written permission.

You keep ownership of the documents and data you upload. You grant us the licence needed to process them in order to provide the service to you.

11. Availability

We aim to keep Solace available and accurate, but we do not guarantee uninterrupted access. We may change, suspend or withdraw features, and we may carry out maintenance.

12. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for loss of profit, loss of opportunity, or indirect or consequential loss, and we are not liable for any tax, penalty or interest charged to an estate or to you personally where it results from information you provided being inaccurate or incomplete, or from a decision you took.

Subject to the paragraphs above, our total liability to you in connection with the service is limited to the total fees you have paid to us in the twelve months before the claim arose, or £100 where no fees have been paid.

If you are a consumer, this does not affect your statutory rights.

13. Suspension and termination

You may stop using Solace at any time and ask us to close your account. We may suspend or end your access if you breach these terms, if we are required to by law, or if we reasonably believe the account is being used without proper authority. We will give you reasonable notice and access to your data where we can.

14. Changes to these terms

We may update these terms. The date at the top shows when they were last revised. Where changes are material and affect an active account, we will tell you directly.

15. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your local courts.
